Burglary Suspect Caught On Shop CCTV

Police are hunting this suspected burglar, caught on CCTV using bank cards taken during a residential break-in, to buy cigarettes.
Between 11.00am and 18.40pm on Monday, April 16, the address in Avignon Road, Brockley was broken into whilst the homeowners were out.
Four Apple computers, a mobile phone, a bicycle, bank cards and a quantity of cash were taken.
The suspect then used the victims’ bank cards in four shops in Catford to purchase cigarettes via contactless payment.
Officers in Lewisham are investigating.
PC Gerald Baffoe-Bonnie, from the Integrated Offender Management Unit, said: “Following CCTV enquiries in the shops in Catford, we wish to speak to the man pictured in the images in connection with this burglary.
I would urge anyone with information or who knows of this man’s whereabouts to get in contact.”

No arrests have been made and enquiries continue.

Bostall Heath Rape: E-Fit Of Two Suspects Released

Police investigating the rape of a woman, who got into a car with three strange men, have released this e-fit of two of the suspects.
In the early hours of Sunday, May, 27 a 47-year-old woman was approached by the trio of males in a Ford Ka on Plumstead High Street, with the junction with Church Manor Way.
The victim got into the car voluntarily and was taken to a car park at Bostall Heath on Longleigh Lane where she was raped.
She was then driven towards Plumstead High Street where she managed to run from the car to a nearby address to seek help.
The suspects were not known to the victim.
Detective Inspector Steve Birchall, from the Met’s Child Abuse and Sexual Offences Command, said: “This is a rare occurrence and while patrols in that area have not identified any suspects in this case there has been no further such offending.
If you believe you can identify either of these suspects from the e-fits then please contact the police.”

Businessman Banned From His £3.8m Home After Chucking Wife's Phone Against Wall

A businessman has been banned from entering his £3.8m South Kensington matrimonial home after throwing his estranged wife’s mobile phone against a wall - damaging the £15 case - during a row.

Company director Gregory Arthur Mihalcheon, 52, found himself being prosecuted after wife Andreia, the named secretary on many of his enterprises, insisted on making a statement to police.

The couple are in the middle of a divorce, which involves a dispute over the ownership of a car, and Mihalcheon has moved into the exclusive The Chilterns development in Paddington Street, Marylebone.

He was charged with causing criminal damage to the phone case at the matrimonial home in Wetherby Place on July 26, but yesterday at Hendon Magistrates Court the prosecution offered no evidence in exchange for Mihalcheon being made subject to an indefinite restraining order.

He is prohibited from contacting Andreia, the mother of their son, 15 and daughter, 10, except via solicitors, social workers, civil mediators and the Family Court. 

He is also prohibited from entering Wetherby Place.

The moustachioed Canadian-born entrepreneur, who was wearing a blue sports jacket, light creme chinos and brown brogue shoes, did not have to give evidence.

Mihalcheon was sleeping alone in the basement of the family home shortly before a row began at 7.20am.

Andreia told police: “He yanked the phone out of my hand and it was so violent I was shocked. He threw the phone across the room into the wall by the fireplace and the phone fell into the fireplace,” the court heard.

“The Crown would say that behaviour is harassment,” said prosecutor Kate Seal. “The Crown Prosecution Service will offer no evidence, but a restraining order is applied for.”

Pushing for a ban on Mihalcheon entering the street where his former home is located, she added: “This complainant would feel far more assured.”

Mihalcheon hired QC David Spens to defend him and insisted he did not intend to damage the phone case or was reckless, insisting he was acting in self-defence.

Magistrate Mr. Adrian Gifford commented: “This is not the high end of domestic abuse by any means.”

He told Mihalcheon: “You have no criminal record, but we have approved a restraining order, preventing you from contacting your wife directly or indirectly, except through a social worker, civil mediation, the Family Court or solicitors.”

Mihalcheon is allowed one visit to the property to collect the rest of his belongings.

He was concerned how the restriction would effect his ability to continue making arrangements to see his daughter, but was assured he could communicate with Andreia as long as this was limited to child access issues.

Andreia left the court alone by a separate exit after her husband and his legal team departed, but did not want to talk about the case.

Olympic Sprint Legend Christie's Son Locked-Up

The drug-dealing son of former sprint star Linford Christie was jailed for four years yesterday for dealing crack cocaine and heroin.

Liam Oliver-Christie, 33, of Lakeside Road, West Kensington appeared on bail at Isleworth Crown Court to change his plea before a scheduled trial next week.

He pleaded guilty to possessing crack cocaine, with intent to supply, on November 9, last year and possessing heroin, with intent to supply, at his home address on the same day.

Oliver-Christie, who has previous drug convictions, had been fighting the case and was due to start a two-day trial on October 1.

He received four years on each count to run concurrently with each other.

Dad Linford won gold for Great Britain in the 100m at the 1992 Olympic Games in Barcelona and was also victorious in the event at World, European and Commonwealth championships.

Liam’s mother is former typist Yvonne oliver, who had a short relationship with the athlete and he has a twin sister Korel.

"Lonely" Detective Stalked Female Cop

A lonely detective constable stalked a female colleague by loitering outside her home and waiting for her at a local bus stop as she travelled to work.

Ironically Jose Lagares, 48, had been confided in by the policewoman after an ex harassed and threatened her and he even tried to influence that investigation.

The father-of-two is based at the Metropolitan Police’s Central North Command Unit, which covers the boroughs of Camden and Islington.

Lagares, of Highfield Road, Princes Risborough, Buckinghamshire pleaded guilty to stalking Svetlana Puzovic between September 1, 2017 and August 24, this year.

His lawyer told Wimbledon Magistrates Court, which bailed the officer until October 17 for a probation report: “This is a situation borne out of extreme loneliness rather than any psychological issues.”

Prosecutor Miss Julie Idowu told the court yesterday: “They are both serving police officers and the defendant has attended the complainant’s home approximately ten times.

“He has been seen outside the front and around her address.

“They were friends and had been friends for fifteen years.

“The complainant had a relationship with another officer based in the USA.

“She told this defendant about that relationship, which ended with that individual stalking and threatening the complainant.

“She told the defendant about it and he researched her ex-partner and found his address in the USA and information about him, including his date of birth and photos of him.

“She told him to stop and let the police investigation take its course, but he continued to investigate this matter and asked the officer in the case to send all correspondence to him.”

On New Year’s Day Svetlana spotted Lagares at the bus stop near her Vauxhall home and at 7.40am on April 26 he was outside her address.

She saw him while travelling to work on April 29 and again on May 3 as she travelled to her local gym.

“The defendant would be seen hiding in the stairwell in the building opposite her home,” added Miss Idowu.

“Another time he was waiting at her regular bus stop and got on the bus after speaking to her.”

Lagares has been moved to restricted duties at Charing Cross Police Station and remains on bail on condition he does not contact Svetlana.

Vodka-Drinking Mercedes-Driver Banned For Three Years

A Mercedes-driving mum was caught swigging from a vodka bottle while four times the drinks limit with a two year-old boy sitting on the back seat.

Jo Newberry, 42, an advertising and marketing senior account director was reported to the police by shocked members of the public, who spotted her boozing while sitting in the drivers’ seat.

She pleaded guilty to driving the black 2.1 litre A-Class vehicle in Raleigh Avenue, Tolworth on July 6 with 148 microgrammes of alcohol in 100 millilitres of breath. 

The legal limit is 35.

Newberry, a graduate of the University of Central Lancashire, also pleaded guilty at Wimbledon Magistrates Court to being drunk in charge of a child.

“At midday police received a call reporting this defendant drinking vodka while at the wheel of her vehicle and with a child present in the car,” said prosecutor Ms Caroline Mungal yesterday.

“The vehicle was parked outside the Sunray NHS surgery and when officers arrived they describe her smelling strongly of alcohol and her speech was slurred.

“The police officers say it was obvious she was not in a fit state to drive.”

CCTV confirmed Newberry had driven to this spot. “Her black Mercedes slowly turned into Raleigh Avenue and pulled over as other vehicles struggled to pass.”

Newberry, of Bruce Hall Mews, Brudenell Road, Tooting Bec was ordered to complete 250 hours community service work, was banned from driving for three years and must attend 16 hours of drink-drive rehab.

For the drunk in charge of a child offence she was fined £330 and ordered to pay £85 costs and an £85 victim surcharge.

“She is extremely remorseful and very aware how serious this offence is and that she could have endangered her life, the child’s life and other road users,” said Gayle Farrell, defending.

Newberry had just abandoned her plan to drive to Portsmouth to visit her father, suffering flashbacks on the A3 to the time she would often travel to visit her dying mother ten years ago.

“She pulled in where there was a corner shop and bought a bottle of vodka and drank some there and then drove to where she was seen by members of the public.

“Everything just came back and she could not make that journey and her plan was to call her husband and say she could not drive, but the police were called.

“She has depression and anxiety and has tried to combat her own alcoholism. It is a serious problem,” said the lawyer.

The court heard Newberry attended AA meetings before her arrest, sought help from a psychotherapist and her GP and spent two three-week stints in residential detox.

She is now celebrating 55 days of sobriety.

Magistrate Richard Standon told her: “Due to the efforts you have made to address your problem and the fact you are a mother to a young child means we can depart from our usual sentencing guidelines.

“You have taken a lot of steps to address your drinking problem and we wish you success with that.”

Repeat Rapist Jailed Again

A repeat rapist has been locked-up for thirteen and a half years for attacks on a woman two decades ago.
Richard Green, 48, was sentenced at Snaresbrook Crown Court.
The court heard the victim came forward in 2012.
She explained Green began abusing her when she was aged 19 years-old while they were living together in Chingford, east London between 1997 and 1999.
Green pleaded guilty to four counts of rape; multiple incidents of false imprisonment and causing actual bodily harm.
The victim also suffered a miscarriage during the assaults.
The court also heard Green had already been convicted and imprisoned for rapes on two separate occasions against other women and was jailed for ten years in 2000.
He was then convicted of another rape and in 2012 received a concurrent sentence of six years and three months.
Detective Constable Chris Sains, who led the investigation, said: "This is an historic case stemming back 20 years, but despite the length of time since the incidents Green has been convicted of his crimes.
"The victim has shown a great degree of courage, persistence and determination in securing the conviction, having persevered with the allegation and supporting the police investigation.
"The victim has had to live with this trauma and the absolutely horrendous violence she endured for the years she was under the control of Green and will have to live with these memories of the abuse for the rest of her life.
"Green is a dangerous, controlling and manipulative individual who has been convicted twice previously for rape.
“He will continue to spend a substantial period his life in prison where an individual of his heinous character should be.
"Given Green's history of abusing women it cannot be discounted that there are other victims of his.
I would urge anyone who has been a victim of Richard Green to contact police - specially trained officers are there to support you."

Croydon Stabbing: CCTV Image Released

Detectives have released the image of a man they urgently want to speak to in connection with an unprovoked stabbing in Croydon.
Police were called to at approximately 3.50pm on Wednesday, July 25 to Selsdon Road.
The victim, a 26-year-old man, told officers that he was sitting outside a property on Selsdon Road when a man walked past in the direction of Brighton Road.
The man suddenly stopped in front of the victim, pulled out a knife from his backpack and lunged at him.
The victim attempted to move away but was stabbed in the chest, close to his right shoulder.
The man then put the knife back in his bag and casually walked off.
Officers took the victim to a south London hospital for treatment.
Detective Inspector David Willis, from Croydon CID, said: “We desperately want to locate this man as he poses a real risk to the public, and maybe, even himself.
This appears to be a completely unprovoked attack that could very easily have turned into a far more serious incident.
It is by sheer luck that the victim did not suffer any life-changing injuries.
“If you know who this man is, please call Croydon CID on 07769 922321 or via 101 as a matter of urgency. We urge you not to approach him.”

Hubby Live-Streamed Beating Of Estranged Wife To Pakistan

A violent husband live-streamed online footage of beating his wife to relatives in Pakistan, boasting: “I’m going to kill her today.”

Uber-driver Rahman Ullah, 38, repeatedly struck 34 year-old estranged wife Raja with the heel of his shoe, inflicting two black eyes and mimicked stabbing her with a kitchen knife he grabbed.

He pleaded guilty to assaulting his Tesco-manager wife, causing actual bodily harm, at their former matrimonial home in Lansdowne Road, Croydon on May 9.

The father-of-two received 14 months imprisonment and Recorder Tom Forster told him: “You were engaged in a WhatsApp video call to Pakistan, informing them you were going to kill her.

“Not content with your boorish behaviour you pursued her to the communal hallway and by her hair dragged her back into the flat.

“She was understandably tearful and you tormented her with a knife, repeatedly making stabbing motions towards her and said you were going to kill her.

“She got two very visible black eyes and obvious bruising to the sides of her face. You gave her a brutal beating.

“You used the heel of a shoe as a weapon and used a knife as a weapon to threaten and filmed the whole thing on a phone.”

Prosecutor Faye Rolfe told Croydon Crown Court the couple had been married for thirteen years until splitting twelve months before the attack.

When Ullah arrived to drive their daughter to school he tricked her into handing over the front door key and let himself in.

“His wife was shocked to see him and he was on his phone, making a WhatsApp video call to his mother and brother.

While holding the phone in a self-style he said: ‘I’m going to kill her today.’

“He hit her with the heel of his shoe ten to fifteen times.”

Raja fled the flat barefoot, but only made it to the communal hallway. 

“He dragged her back down the hallway by her hair and she hit her head on the floor,” added Ms Rolfe.

“She is thrown onto the couch and Ullah goes to the kitchen for a knife and makes a stabbing motion towards her.

“He said: ‘I’m going to stab you’ and she genuinely thought she was going to be killed and this was still being filmed.

‘The fact that hit was filmed makes it more humiliating for the victim.”

Afterwards Raja said: “I’ve not been sleeping well. I’m aching all over and have a bruise to my head, where I was dragged by the hair.

“I’m scared to sleep in case my husband gets back in the house to kill me.

“I took a week off work because I did not want to be seen in that state.”

Ullah initially told police his wife was the aggressor and attacked him until eventually admitting his guilty and also being made subject to an indefinite restraining order.

Octogenarian Groped Young Women On Pub Dancefloor

An octogenarian drunkenly celebrating his landmark birthday put his hand up one young woman’s skirt and twice grabbed another’s bum between dance floor moves in a packed pub.

Pensioner Jaime Arrochela Lobo, 80, who has a heart pacemaker, told police after he was arrested in the early hours that he enjoyed dancing and chatting to girls.

He was convicted of sexually assaulting a 23 year-old and her 24 year-old friend at St. Christopher Inn, Borough on March 25 and will be sentenced on October 18.

“I felt a bit sorry for him so said: ‘Hi.’ I thought if I saw someone like my grandfather I’d feel a bit sorry for him. The people in the pub were in their twenties and thirties,” said the first woman.

“I turned away and a minute later I felt his hand up my skirt inside my underwear and touching my vagina.

“I turned around very quickly and pointed my finger in his face and called him disgusting. I was very upset and went outside to compose myself.

“I felt vulnerable, angry and violated.”

Her friend told Croydon Magistrates Court: “This man came up behind me and touched my bottom so I turned around and told him not to do that.

“Later on the same man did it again. It was like a grab.

“It did make me feel a bit uncomfortable and violated and I was a bit angry with him.

“I did question why and old man would be there on his own in a young environment.

“I went outside and my friends very distraught, crying, lots of tears and was really upset.”

Arrochela Lobo, of Brinklow House, Torquay Street, Paddington was arrested at the pub and told police: “I like dancing and speaking with young girls.”

He told the court he has a pacemaker and undergone surgery to replace a heart valve and suffers from involuntary shakes.

Former car salesman Arrochela Lobo said he had “plenty” to drink. “I was dancing with different ladies. I got out of the house because I was a bit upset with my girlfriend.

“I can’t say if what the two woman say is true or not because I can’t remember.”

Paedo Guilty Of Abuse Five Decades Ago

A Wiltshire man was convicted yesterday of repeatedly sexually abusing a young girl ten years his junior five decades ago when sneaking in to her bedroom after a night's drinking.

Robert Johnson, 67, of Chadwick Close, Bowerhill, Melksham was aged eighteen years-old when the abuse began at a former address in west London.

He was found guilty at Isleworth Crown Court of one count of indecency with a child between August 19, 1969 and August 19, 1971 at the Perivale house.

Johnson, who now uses a walking stick, was also found guilty of two counts of indecently assaulting the girl, who was eight years-old when he molested her, between the same dates.

Following the three-day trial the jury reached their verdicts after four hours of deliberation.

Prosecutor Mr. Charles Royle told the court: “She recalls a pattern of behaviour when Mr. Johnson came back from the community club, having been drinking.

“He was eighteen years-old at the time and she was eight years-old and remembers him exposing himself to her when he came into her bedroom after the club and woke her up.”

The complainant says Johnson then forced her to perform intimate sexual acts on him.

“This behaviour continued on other occasions and the complainant would try and hide in the toilet,” explained Mr. Royle.

After a year she reported Johnson, but was a branded an “evil child” by those close to her, the jury were told.

However, she eventually made a statement to police and Johnson was arrested at his home on February 9, last year.

“He said the allegations were rubbish,” added Mr. Royle.

The jury were played the complainant's video-recorded police interview in which she tearfully recalled: “The first time it happened he came into my room, woke me up and said that he wanted me to touch him, which I did.

“I was a bit surprised and from that moment it progressed. He would come in and tell me to be quiet.

“He use'd to have a bit to drink and that's when he came up to me. I use'd to lock myself in the toilet.”

Johnson was bailed until October 4 for sentencing.

Fifteen Year-Old Schoolgirl Molested On Bus: CCTV Released

Police are hunting this suspected bus pervert who a 15 year-old schoolgirl says groped her thigh after sitting next to her on the top deck.
At around 9.00am on Friday, January 12, the victim boarded the 149 bus at London Bridge, Southwark and sat on the upper deck towards the front.
A short while after, a man got on the bus and sat directly next to the girl.
He then sexually touched her thigh.
The suspect is described as a white man, aged in his thirties, around 5ft 9ins tall, of skinny build and with short, light brown hair.
He was wearing a dark, wool waist-length coat with a fur hood and light blue jeans.
Detective Constable James Eccleston, from the Metropolitan Police's Roads and Transport Policing Command, said: “This assault, which took place in broad daylight, has left this young girl shaken and upset.
If you were on that bus, or know who this man is, please get in touch.”

Pensioner Denies Molesting Young Girl Five Decades Ago

A Wiltshire man repeatedly sexually abused a young girl ten years his junior five decades ago by sneaking in to her bedroom after a night's drinking, a court heard yesterday.

West End Rape: E-Fit Of Suspect Released

Police hunting a theatreland rapist, who attacked a 19 year-old woman he led into a secluded alley as she waited for a cab in the early hours, have released this e-fit.
The offence occurred at around 2.50am on Saturday, May 5 in Exchange Court, The Strand.
The victim was waiting for her minicab on The Strand after being out with friends.
She was then approached by a male who said he could help her locate it.
Moments later he led her down a secluded alleyway where he raped her.
The suspect is described as being an Asian male with short brown hair and facial hair.
Officers from the Metropolitan Police's Child Abuse and Sexual Offences Command (CASO) are investigating and have released an e-fit image of a man they would like to speak to in connection to the incident.
Detective Inspector Liz Wilcox, from CASO, said: “This woman was targeted after being separated from her friends.
I would urge anyone with information which may assist this investigation to come forward. Any information we receive will be looked at thoroughly and sensitively.”

Acid Attack Horror In East London

Police in east London are hunting an acid attacker, who sprayed this victim as he opened the boot of his car.
Andrew Walker, 38, heard a noise behind him in Waltham Road, Woodford Green on January 20 and when he turned an unknown male doused him in the corrosive liquid.
An ambulance rushed him to hospital just after 9.20am for treatment to his injuries, which have been deemed life-changing.
Andrew was able to tell officers that the suspect was a young white male.
He did not recognise him and the suspect was later spotted on camera getting into a red BMW 1-Series.
The attack, which was entirely unprovoked, is being treated as GBH with intent.
Mr. Waker said: "The person who attacked me changed my life forever, and I am constantly reminded of the pain they caused when they randomly attacked me earlier this year.
"I would urge anyone with any information to come forward to the police as soon as possible so that this person can be put behind bars and won't be able to harm anyone else for a long time."
Lead investigating officer, Detective Chief Inspector Jamie Piscopo said: "This was a shocking attack on an innocent man going about his daily business.
He has received life-changing injuries, including extensive burns and scarring to his arms, face, and the left side of his body.
"At this stage, we are unsure as to what the motive for this was attack was or why someone would want to harm Mr. Waker in this way.
"We're releasing the CCTV images in the hope that somebody will recognise the suspect and get in contact with us.
“It shows the suspect running away and a red car, which we also believe to be involved.
"I would encourage anyone with information to contact us on 0208 345 2714 or tell us what they know anonymously by contacting Crimestoppers."
There has been no arrest in this investigation.

City Cyber Specialist In Drunken Pub Assault

A former Royal Marine turned cyber security expert drunkenly assaulted bar staff while trying to retrieve his bag in a City pub.

Kristian Tennick, 34, an executive consultant with Bishopsgate-based KennedyPearce Consulting was drinking with a group at the nearby Britannia pub.

He left his bag - containing his door key - behind and was too  drunk to properly identify it to staff and aggressively tried to grab it from behind the bar.

Tennick, of Falcon Brook Mansions, Balham High Road, who served as a signaller in the armed forces between 2003 and 2007, pleaded guilty to assaulting barman Sean Innes and manageress Hannah Gladwin on January 22.

Prosecutor Mr. Matt Barrowcliffe told City of London Magistrates Court Tennick left the pub at 8.30pm, but returned 45 minutes later.

“He attempted to buy another drink, but this was refused due to his level of intoxication.

“Staff had his bag that he left behind, but because he could not properly identify it refused to give it to him.

“This upset the defendant and he tried to force his way behind the bar and assaulted Mr. Innes by trying to push past him several times.

“Ms Gladwin is pushed and struck multiple times, about four. She describes them as strikes, but cannot say they were punches.

‘It is assaulting two people in their place of work and aggravated by and extreme level of intoxication at the time.”

Tennick had always denied the charges, but eventually admitted the assaults after viewing the CCTV footage for the first time before the scheduled trial.

He told the magistrates: “I am really sorry. It felt reasonable at the time, but having seen that I can see it was excessive.

“This has been an awful six-month period waiting for this looming over me and knowing the impact it will have on my life and my future career and working overseas.

“It could ruin everything I’ve worked hard for and achieved.”

His lawyer Keith Myers told the court: “This incident was borne out of stupidity. He had been out with friends drinking.

“In his bag was his door keys and he tried to push past both the barman and the manageress, who says she was struck on the back.

“He apologises from the bottom of his heart. Unfortunately he saw red when he couldn’t get his door keys.”

Magistrate Colin Bateman-Jones told Tennick. “You were clearly very drunk. You couldn’t identify the bag and hit Ms Gladwin four times.”

He was conditionally discharged for two years and ordered to pay Ms Gladwin £400 compensation and Mr. Innes £100. 

Tennick must also pay £310 costs and a £20 victim surcharge.

Entrepreneur Guilty Of Thumping Property Mogul In Mayfair Nightspot

A property tycoon has been convicted of repeatedly striking a wealthy rival in a Mayfair nightclub, despite claiming it was self-defence after being called a: Lying shyster jew.” 

Simon Lyons, 38, the joint chief executive of Enstar Capital was fined £3,000, with £5,956 costs, plus a £170 victim surcharge and made subject to a 12-month restraining order.

He was found guilty of assaulting Giles Cyril Patrick Mackay, 56, just after midnight at Dover Street’s MNKY HSE on October 7, last year.

Mr. Mackay, who founded property analytics company Hometrack, reportedly sold to Zoopla for £120m last year and is also a House of Commons advisor says he was attacked after greeting Lyons’ girlfriend Andrea.

Afterwards his spokesman said: “Mr. Mackay is pleased with today’s verdict. He was subjected to an unprovoked attack in full view of other clientele at the venue.

“He is pleased the judge said that he was sure Mr. Mackay made no antisemitic comments to Mr. Lyons and was not physically aggressive.

“To be clear, Mr. Mackay is not antisemitic and would never use a phrase like this. He is repulsed by the claim that he did.”

Mackay told the City of London Magistrates’ Court trial there was no hint of trouble when he exchanged greetings with Andrea.

“We kissed each other on both cheeks and the next thing I know I’m hit by Simon. I was not expecting to have Simon leaping around the table and smacking me in the face.”

Lyons, of New Cavendish Street denied the offence, claiming he was acting in self-defence and was in fear of his life.

He was behind the development of 54 Brooks Mews, Mayfair, London’s most expensive-ever commercial per-square foot re-fit when completed for £4m three years ago.

The pair had exchanged angry emails after becoming embroiled in family proceedings at the High Court, involving Lyons and his ex.

“I am not satisfied so that I am sure that religiously inflammatory language was used by Mr. Mackay,” announced District Judge Davinder Sandhu.

“I am satisfied Mr. Lyons thought Mr. Mackay used religiously-charged derogatory language towards him that resulted in a loss of self-control and strike out with an open palm towards him.

“It’s clear these are two men, who sadly dislike each other profoundly.

“I don’t find self-defence arises in his case. There was no question of self-defence. Mr. Mackay did nothing on the CCTV that could be physically threatening or aggressive.” 

Mr. Mackay told the court: “I was distressed that someone I thought was normal, affable and friendly was something else. I was not the behaviour of a normal individual”

He went to the police, who issued the order, and he admits replying to Lyons in emails: “You’re f***ing crazy.” “Shut the f*** up.” “You are a bully a coward.” “You made vile, venomous, unwarranted attacks on me.” “Piss off, you’re mad.”

He was drinking his second vodka and standing in a dance area at the Latin American restaurant when struck and told police afterwards: “He punched me in the face and continued to violently attack me until he was pulled away by the security guards and ejected.”

Mr. Mackay told the trial: “He first hit me across the table and then he came around the table. I think he did run around the table.

“I had a notice that he should not harass me or come anywhere near me if we were in the same place.

“All of a sudden I saw him leap up from where he was. He pushed past his girlfriend Andrea, pushed her over the table.

“The next thing I know I was being hit in the face. Everything that was on the table got knocked off.

“He came around to my side of the table and was very aggressive by this point.

“I was hit at least three times by Simon. I remember putting my leg up to try and defend myself.”

Mr. Mackay told the court he was the victim of “one-way harassment” by Lyons and did not know he was there that night until attacked.

However, Lyons claims Mr. Mackay instigated the conflict and told Andrea: “Get Simon out of my face,” before approaching and making the insulting anti-semitic remark.

“At no time did I say that,” insisted Mr. Mackay. “I’m not interested in getting into a conflict, I’m fifty-eight, I’m a serious businessman.

“I was not looking to get into a fight. I was attempting to defend myself.”

Lyons’ legal team dug up a High Court judge’s remark from a 2012 civil cases in which he said Mr. Mackay was “careless with the truth.”

The restaurant’s CCTV of the incident was circulated by Mr. Mackay. “I knew he was sending it around to everybody, it was a campaign to discredit me,” Lyons told the court.

He claimed it seemed Mr. Mackay was planning something that night. “He was texting people. I was scared for my life. To be honest I don’t know what Mr. Mackay was capable of.

“He came charging into the place. I was scared, I wasn’t expecting to see him. 

“I’ve never seen anyone’s eyes like that before. I’ve never been so frightened in my life.

“I thought he was going to come at me. I was not being paranoid, I thought I was going to be attacked.”

Regarding the alleged anti-semitic insult Lyons added: “It was the venom, the way he said it. I thought he was going to go for me and I used what I thought was a necessary method to restrain him.”

After landing the initial blow the CCTV captures Mr. Mackay raising his left leg while seated to ward off Lyons, who then starts leaning over him pointing.

“I’m telling him: ‘Lave me alone. Please leave me alone.’ I was scared, I was terrified of what he would do.

“He was being very menacing up to that. He said he was going to have my child taken away from me.”

When quizzed by police Lyons suggested the insulting remark may have been prompted by Mackay’s opinion of financial disclosures he (Lyons) had to make in the Family Court.

“I possibly stupidly slapped Mr. Mackay and he kicked me and I slapped him again and he hit me,” he told the officers.

“I do regret slapping Mr. Mackay. I don’t go around hitting people and his kick was a lot harder than the slap.

“His eyes were mad. He looked crazed, like he’d taken drugs.”

Six-feet plus Lyons, who works out daily added: “If I hit him he ‘aint getting up after that.

“I firmly believe Mr. Mackay will be seen as a racist. It was total provocation.”

In his victim impact statement to the police Mr. Mackay said: “I had a sore jaw for a couple of days from the assault,” adding he had endured weeks of “obscene, crude and threatening” emails from Lyons shortly before.
