Cyclist Tragedy: Cement Mixer Driver In Dock

A brilliant award-winning interior design student cyclist was crushed to death under the wheels of a 32-tonne cement mixer lorry when the driver failed to spot her, a court heard yesterday.

Italian Giovanna Cappiello, 29, was just two weeks from graduating her foundation degree course at the University of the Arts, Chelsea when she died on July 4, 2019.


Construction company boss Stephen Hempenstall, 52, of Thornhill Road, Ickenham, Uxbridge has pleaded not guilty to causing her death by careless driving.


Prosecutor Mr Hamish Common told the jury: “The prosecution case is that Miss Capiello was there to be seen, however Mr Hempenstall did not look properly and use the visual aids, for example mirrors and lens, available to him before turning.


“The prosecution say he was careless, was driving distracted and did not make the proper checks.


“He was earlier driving in a clearly distracted state and Mr Hempenstall did not look left at all in the run up to that left turn and did not respond to his side scan warning system.”


Inner London Crown Court heard the tragedy occurred at 3.10pm at the junction of Wandsworth Road and Silverthorne Road, south-west London as Bologna-born Miss Cappiello rode her purple Carrera pedal bike.


Miss Cappiello, - known as ‘Gio’ - the first student on her course to achieve A+ grades in both theory and practice, was run over as the LGV Mercedes Arco cement lorry turned left at traffic lights.


A winner that year of the Chartered Society of Designers student award Miss Cappiello - the daughter of an Italian State Police Chief Inspector - also worked at the five-star Berkeley Hotel, Belgravia and was dating fellow-Italian Daniel Caseri.

Mr Common said: “The lorry arrived a the traffic lights first and stopped and Miss Capiello cycled past the nearside of other stationary traffic until the lights turned green.


“As the lorry moved away Miss Capiello caught and began to pass the lorry on its left. As Miss Capiello drew alongside the cab area of the lorry Mr Hempenstall turned left across her and runs her over.


“The lorry was in the middle of a steep turn left at the point of the collision when Miss Capiello and her bicycle went under the front of the lorry.”


A London Air Ambulance arrived at 3.22pm, but tragically Miss Capiello had suffered a serious straight-line injury across her chest and abdomen.


A post mortem gave the cause of death as multiple injuries.   


Horrified witnesses saw the tragedy unfold at the busy junction and van delivery driver Martin Butcher told police: “The cyclist was about half way along the lorry when it began to turn and the lorry collided with the cyclist.”


Motorist Elizabeth de Rougemont said: “I could see the accident was going to happen.”


Matthew Claridge said he was first alerted to shouts of “stop.” “I could see the lady under the wheels of the moving lorry. She was tumbling in the wheels and then the second one went over her.”


He approached and heard no music from her EarPod. “Her bike was lying behind her in the road and it was completely destroyed.” 


Motorist Scott Martin recalled: “Unfortunately I saw everything from start to finish. “I was like: ’No, no, no,’ as the truck started creeping in and the cyclist is trying to get away.


“It comes around and she clips it just a bit back from the cab and I am screaming at the f***ing driver: ‘F***ing stop, stop, stop.’


“He is doing the manoeuvre at walking pace, but she never came into the zone where he could see her. This is all at 5mph, maybe 2mph.


“She looked at me as she went under the thing. I saw it drive over her,” added thew witness, who said he did hear music coming from the cyclist’s EarPod.


Hempenstall had just left the Battersea Concrete Plant in Silverthorne Road after reloading with ready mix concrete and his cab’s own CCTV shows him preoccupied with some paperwork in the moments before the tragedy.


“Mr Hempenstall was holding some paper in his right hand whilst he was driving. A short time after the start of the journey he unfolded the paper and seems to have been reading it while he was driving along,” explained the prosecutor.


“He then folded the sheet of paper, but continued to hold it in his right hand and on several occasions shuffled it from his right to left hand and back again.


“His mouth was also moving and it appears as if he was talking or singing.


“While driving he was holding a piece of paper in his right-hand side and steering and at one point put his seatbelt on.


“Mr Hempenstall folded the piece of paper and was holding it in his left hand and he waved at another driver.”


At the traffic lights the defendant indicated left, triggering a speaker on Ms Cappiello’s side, announcing: “Caution. This truck is turning left,” accompanied by white noise to cut through the surrounding noise.


“Mr Hempenstall contends that he did check and that his driving was not careless. Further, the side scan system would have activated, given Miss Capiello’s position in respect of the lorry, which would have alerted Mr Hempenstall to her presence.


Hempenstall has instructed his own collision consultant, David Loat, who has worked alongside the Metropolitan Police’s Serious Collision Investigation Unit and will give evidence during the trial.


The court heard Hempenstall’s ‘London Concrete’ lorry was fitted with CCTV and the side scan system and exhibited various warning signs to the side and rear.


The Brigade Electronics side scan proximity sensor system alerts the driver to any road users dangerously close to the inside of the lorry and four such sensors were fitted to the vehicle.


After the collision the sensor system passed safety checks and the prosecution case is that Hempenstall should have heard and acted on the audible warning.


After the collision fully licensed and insured Hempenstall pulled over. “In brief he said he did not see Miss Cappiello,” added Mr Common.


He spoke to an officer at the scene and said: “I don’t know where the cyclist I hit came from. I did not see her in my mirrors.”


The trial is expected to last a week……

Who's The Hoodie?: Police Seek Tube Train Thug

British Transport Police (BTP) are hunting this suspected violent thug after two male passengers were assaulted on the London Underground.

Officers have released this CCTV image and are requesting the assistance of the public to help identify him.

At approximately 10.40pm on Saturday, December 9, last year the two victims boarded a tube train at Preston Road Station, north-west London on the Metropolitan Line.

They were both assaulted by a mystery male, who fled the station afterwards.

Each of the men suffered injuries as a result.

Officers would like to speak to the man in the image as they believe he may have information that could help their investigation.

Homophobic Hate Crime At Bank Underground Station

A couple travelling on the London Underground were punched and kicked during a homophobic attack.

They were initially verbally abused by the mystery man, who is now wanted by transport cops.

British Transport Police (BTP) have released these two CCTV image of an unknown male and are requesting the assistance of the public to identify him.

BTP are treating the incident as a hate crime.

The victims were walking through busy Bank Underground Station in the heart of the City at approximately 4.45pm on November 12, last year.

A man approached and began verbally abusing them, before following the couple and kicking one and punching the other.

Officers would like to speak to the man in the image as they believe he may have information that could assist their investigation.

Passenger Hospitalised By Train Assault

A train passenger was hospitalised with a fractured shoulder and facial wounds after being punched and stamped on while travelling on a late-night service.

British Transport Police (BTP) have released this image of their unknown suspect and are requesting the assistance of members of the public to help identify him.

The victim was travelling between Ramsgate and Dover, Kent at approximately 11.00pm on Friday, December 29, last year.

A male passenger punched and stamped on his upper body and head, rendering him motionless on the floor.

The victim attended hospital and was left with a fractured shoulder and stitches needed to his face.

Officers would like to speak to the man in the image as they believe he may have information that could help their investigation.

JAILED: Tube Train Creep Who Targeted Lone Woman

A tube train creep, who pleasured himself while staring at a lone female passenger in a deserted carriage, has been jailed for nine months.

Mukesh Shah, 43, deliberately sat near the woman just before midnight on the Piccadilly Line train travelling through west London, exposing himself and masturbating.

He was captured when British Transport Police (BTP) identified him from footage the woman had recorded in an effort to stop him.

Shah, of Primrose Way, Wembley received nine months imprisonment after he was convicted at Inner London Crown Court of indecent exposure.

He must also sign the sex offenders register for ten years and comply with a ten-year Sexual Harm Prevention Order.

The victim was travelling between Sudbury Town and Acton Town at approximately 11.40pm on November 4, 2022 when Shah boarded the train.

Despite the empty carriage, Shah sat diagonally opposite the woman and she noticed him staring at her, making her feel uncomfortable. 

It was then that she noticed he was exposing himself and masturbating.

Bravely, she captured Shah on camera, hoping it would deter him, but it didn’t.

She confronted him and told him to stop and move away from her and Shah protested he hadn’t done anything wrong, but moved along the carriage.

The victim reported the incident to BTP along with the video, which was circulated within the police and lead to the identification of Shah.

Investigating officer Detective Constable Mark Luker said: “This was a frightening and upsetting experience for the victim and I commend her bravery in confronting the offender, managing to capture an image of Shah and reporting this.

“Shah’s disgusting actions have not only secured him time behind bars, but restrictions following his release to prevent him from repeating his actions in the future.

“We will always take reports of sexual offences seriously and will do everything in our power to bring offenders to justice. 

“I urge anyone who sees or experiences this behaviour to report it to British Transport Police by texting 61016, via the Railway Guardian app, or via 999 in an emergency.”

Tube Train Punch: Police Hunt Scarfed Suspect

Police are hunting this mystery suspect after violence broke out on a tube train in the early hours.

British Transport Police (BTP) have released the CCTV image and are appealing to the public for assistance in identifying him.

At approximately 1.15am on Saturday, December 9 the male victim was travelling on a Central Line Underground train towards Mile End station, east London.

He reported to police that an unknown male passenger punched him in the face, causing bleeding and damage to his teeth.

BTP officers believe the man in the CCTV image may have information which could help their investigation.

'Free Spirit' Behind Bars: Airbnb Rapist Convicted

An Airbnb guest has been convicted of raping a first-time host, who ended up barricading herself in her bedroom and hiding her kitchen knives.

Well-travelled graphic designer Diego Dellarovere, 43, who describes himself as a ‘Citizen of the World’ promised her the next morning: “I’ll leave a good review.”


A Croydon Crown Court jury took approximately three hours to unanimously find him guilty of rape; sexual assault and assault by penetration.


Dellarovere, of Holland Road, West Kensington, who describes himself as a ‘Free Spirit’, spent the weekend in a prison cell after Recorder William Featherby KC remanded him in custody until his sentencing on January 31.


He will also have to sign the sex offenders register.


His exotic travels are chronicled online, where he tells his instagram fans: “Follow Me. I will take you around the world.”


The woman told the trial she became a host to make the most of the spare room in her Wandle Park, Croydon flat, advertising on the Airbnb website.


Her first-ever guest was Dellarovere, who booked for one night on May 7, 2021, despite having a London address.


He told the jury: “I like to explore new places and in that period it was a covid period and I couldn’t travel or visit other places and the idea to go on a night out, it was close to my lifestyle.


“It was cheap and because there was a park close by and I like nature.”


She accepted the booking, despite believing it was a little strange west London-based Dellarovere wanted to spend the night in her quiet corner of Croydon.


During the evening she poured them both a glass of wine and Dellarovere told her about his passion for Reiki therapy, which utilises the body’s natural energy.


In her police video-recorded interview she explained: “He mentioned massage at that point and was following me very close and came behind me and started rubbing my shoulders and I said: ’No thanks.’


“Then when I was sitting on the couch he was touching my legs and said: ‘Put on spa music and I can give you a massage.’


“He was saying: ‘I have oil. I will give you a massage.’


“I felt like he was just looking at me and not wanting just small talk and that’s when things turned,” she told the investigating officers.


“He came forward and pulled me in and started licking and kissing my neck. I pulled back and he was quite strongly pulling me in and I had to forcefully push him away.


“I felt a little bit frozen and he went in again, using a lot more strength and force.


“I was saying ‘no’ quite a lot and pushing and he stuck his tongue in my mouth and moved from there to my breast and his hand went down inside my leggings. 


“I said: ‘I don’t want this,’ and he said: ‘Come on,’ and started talking about that energy stuff we had discussed earlier.


“He put his hand into my trousers and into me and was quite roughly moving his fingers. It was not comfortable.


“He pulled down down his trousers and underwear and sat down,” continued the woman, adding Dellarovere forced her hand between his legs.


“He grabbed my head again, my hair and just pushed forward.”


She said she was raped by force and without consent and afterwards Dellarovere followed her around the kitchen, trying to grab her.


“He started grabbing me again and I said: “You’re really p***ing me off now,” and he walked away, tidied himself up and went into the spare bedroom.”


However, Dellarovere insisted the sexual activity was consensual and occurred after he gave her a relaxing massage.


The father-of-one told the jury during the four-day trial: “There was a sort of chemistry. We were laughing and joking, everything was very natural.


“At that point when there was a kiss she came closer and we became more intimate, we started to hug and touch each other. We kissed and hugged.”


Dellarovere said the “ten to twenty seconds” sex act occurred during a “moment of passion,” the complainant seemed to immediately regret.


“I was going to move and then it was just like she had woken up and she stood up and went back and she said: ’No, no, it’s too soon. I made a mistake.’


“At the point she stood up I still had my trousers down and I stood up and I said: ‘Everything is okay, there’s nothing wrong,’ and I tried to hug her.


“At this point she said: ’No, no,’ and when I heard her I was embarrassed, pulled up my trousers and went in my room.”


The woman told the trial she also retreated to her bedroom. “I went to my bedroom and he was texting me, asking: ‘Are you sure?’ and then texted me that he was sorry and asked if I was angry.


“I was scared because he did not get what he wanted and would go out and bring someone back.”


After getting her pet dog into her bedroom she struggled to convince her reluctant pet cat to follow. “Once they were in I pulled a unit across the door.”


She also hid her knife block, remarking: “I did not know what he was capable of doing.”


Dellarovere had her door keys and returned to the flat at 2.00am after “going for a walk” and spent the night in the spare room.


She left a neutral Airbnb about Dellarovere, which seemed to annoy him, the court heard.


“He responded with an angry face emoji and there was some back and forth messaging in which he said it was consensual and using block capitals, said I LIKED it.”


Dellarovere sent further WhatsApp messages to the woman, including: “You are repressed,” “You’re not a good person,” “You need to be more in your soul not your mind,” “Be an adult, not a baby,” and “I didn’t see any objections from you.”


Dellarovere then blocked the woman, but contacted her again when she reported to Airbnb her concerns about his stay, resulting in her ultimately blocking him.


She told the police: “I was just going to report this to Airbnb and leave it at that. My initial thoughts were it was pointless because it was not going to go anywhere.


“Then my thought was that he is likely going to do that to someone again so I want his name to be flagged.”
